The following terms and conditions apply to all transactions made with and through www.akbearings.co.uk. Please read carefully and print a copy for reference. By using this website, you are agreeing to be bound by these terms and conditions:
CONTRACT
The placing of an order is an offer by you to purchase a product(s). This offer is only accepted at the point of payment. The 'point of payment' is defined as monies cleared into our WorldPay or Paypal account and, for payment by cheque, bankers draft, postal order or direct money transfer, notified cleared funds into our bank account. Any item(s) on the same order which are not charged or paid for do not form part of that contract.
TITLE TO THE GOODS
Title to any item(s) supplied by AK Bearings shall only pass to you upon cleared payment being received by us. Until such cleared payment is received in full by AK Bearings from you, legal and beneficial ownership in any item(s) delivered shall remain with AK Bearings and you shall hold such item(s) on a fiduciary basis as bailee of AK Bearings. If cleared payment is not received within 30 days from the date of delivery of such item(s), AK Bearings shall be entitled forthwith and without notice to repossess all or any part of the item(s) supplied or to require you to deliver all or any part of those item(s) to AK Bearings. We understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under the Late Payment of Commercial Debts Regulations 2002 if cleared payment is not received in accordance with the above.
PRIVACY
We will endeavour to take all reasonable care, in so far as is possible to do so, to keep all details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. ACCURACY OF INFORMATION
Whilst we make every effort to ensure that all information on our website is accurate as far as possible, we will not be liable to you or any third party for consequential or incidental loss including, but not limited to, loss of revenue, profits, expenditure or privacy whatsoever that arise out of, or is related to the use of the website or any information contained therein.
SHIPPING
We aim to process and despatch any order received before 2pm on a working day on the same day, subject to stock availability as detailed herein and subject to any rider message which may be shown during the purchase and/or checkout process. Should there be a delay in despatch, then we will notify you within 48 hours of the expected despatch date or if the product is no longer available. Actual delivery times after despatch will depend on the method of carriage selected by you at purchase and the delivery address given. We deny any liability for delays in delivery or consequential loss arising from such delays. All times quoted by us for despatch or ultimate delivery are estimates only and are not to be the essence of the contract. In the case of non-receipt, it may be that your order is delayed in transit by the carrier which is out of the control of AK Bearings. For UK orders, please wait 15 working days from the date you are notified your order is despatched, 20 working days for European destinations and 25 working days for the Rest of the World.
PRICING
All prices are shown in UK pounds sterling including VAT. We reserve the right to change any advertised prices at any time and without prior notice.
STOCK AVAILABILITY
All products are subject to availability and may be changed at any time. Whilst we attempt to maintain stock levels to satisfy all orders, if, for reasons beyond our control, there is insufficient stock to fulfil any order at the point of despatch, we will notify you accordingly and offer the option to refund monies paid as soon as possible and, in any event, within 28 days. Where a product which makes up part of an order was subject to a stock rider during the purchase and/or checkout process, the order will be held in its entirety until all items from that order are available for despatch.
CANCELLATION
We will accept cancellation of any order prior to despatch, provided only it is accepted that all and any costs, expenditure and loss incurred by us up to the point of cancellation be reimbursed to www.akbearings.co.uk. Once an order status is updated to the despatched level on your account, the order has been processed and will then be subject to the re-stocking fee detailed in the RETURNS clause herein.
DELIVERY
We will deliver item(s) in accordance with the order at the point of payment.
Items will be delivered to the shipping address given by you for delivery at the time of purchase. In the event that any parcel is returned to us marked undeliverable for whatever reason, we reserve the right to deduct the original carriage charge from any refund or to charge additional carriage if we have to resend the same parcel to either the original delivery address or to a new address provided by you. It is your responsibility to provide us with a full, complete and correct delivery address, including postcode, at the time of purchase. If the address you supply does not fulfil this criteria, you will be solely responsible for any additional charges levied by the carrier. For any item sent via Royal Mail which is lost or not delivered as a result of the supply of an incorrect address by you, you will be fully responsible for the delivery failure and will not be entitled to (i) any refund from www.akbearings.co.uk, or (ii) replacement item(s) being despatched.
If ordering item(s) for delivery outside the UK & N.I., please be aware that you may be subject to import duties and taxes. Any additional charges, duties or taxes are your sole responsibility and must be borne by you. It is also your responsibility to ensure that import regulations for the country of receipt are complied with. We will not be responsible for any costs involved in returning refused item(s). If item(s) are returned for any reason including, but not limited to, your refusal to pay import duties, we reserve the right to refund the cost of the original item(s), provided these are received in an unused, undamaged condition and deemed fit for resale by us on arrival at our premises, less any carriage charges incurred both for the original despatch and return of the item(s).
RETURNS
We will accept returns in their original packaging up to 14 days after the date of purchase provided the item(s) are returned at your own expense in an unused, undamaged condition and deemed fit for resale by us on arrival at our premises. Such returns must be accompanied by documentation necessary to enable us to identify the purchaser.
Please ensure that you check the item(s) received is the correct size and/or item(s) you require before opening any manufacturer's packaging. Where an item(s) is supplied in sealed manufacturer's packaging, that item(s) must be returned in that original, sealed manufacturer's packaging and unopened to be eligible for a refund. Any item(s) returned where the manufacturer's packaging has been opened, and/or with any damage to the packaging or the packaging seal, will render such item(s) unfit for resale and we will be unable to process any refund. Such item(s) will remain at our premises until collected by you or until payment is made by you for the cost of redelivery.
Any returned item(s) which is not received by us in its original new condition, (and/or with manufacturer's packaging intact as detailed herein), will be deemed unfit for resale and we will be unable to process any refund. Such item(s) will remain at our premises until collected by you or until payment is made by you for the cost of redelivery.
Until a returned item(s) is received by us and deemed fit for resale, you are responsible for any loss or damage to the item(s) and we recommend you obtain proof of sending in the event that the item(s) does not arrive, or is damaged on arrival at our premises. Once we have received the item(s), we will refund the purchase price paid, less any carriage charges and less fees incurred by us at the time of purchase. Any item(s) returned without the required documentation, received by us damaged or received outside the 14 day time limit are excluded.
We must be notified of any incorrect, damaged, faulty or missing items to any order within 24 hours of receipt by you, whereupon we will attempt to rectify the situation immediately, subject to stock availability. We may ask for an incorrect item(s) to be returned in its original packaging at the customer’s cost (cheapest method of return carriage must be used with proof of despatch obtained in the event a returned item is lost or damaged in transit prior to arrival at our premises) together with documentation to enable us to identify the purchaser. Once we have inspected the item, a full credit inclusive of cheapest return carriage will be issued via the same payment method used by you at the time of purchase.
In the event a faulty or damaged item(s) is received, you must return the item(s) to us in its original packaging, initially at your own expense, (cheapest method of return carriage must be used with proof of despatch obtained in the event a returned item is lost or damaged in transit prior to arrival at our premises), together with documentation to enable us to (i) identify the purchaser; and (ii) establish the nature of the fault or damage. It may be necessary for us to pass the item(s) for expert assessment of any alleged fault or damage, which we agree to do in a reasonable time not exceeding 21 days. In such cases where deemed fault or damage is found, either replacement item(s) will be despatched to you, subject to stock availability, or a refund given via the same payment method used by you at the time of purchase. In cases where no fault or damage is found, no refund will be issued and the original item(s) will remain at our premises until collected by you or until payment is made by you for the cost of redelivery.
Any item(s) returned to us at our premises without satisfactory documentation to enable identification of the original purchaser will be treated as abandoned.
Except in the case of a proven faulty or incorrect item, any item(s) returned will be subject to a 20% re-stocking fee.
LIABILITY
www.akbearings.co.uk will not be liable to the purchaser or any third party for loss, damage, injury or death either direct or indirect, due to the failure of any item(s) supplied nor shall we be liable for loss or damage to any property in which the item(s) may be incorporated or with which or near to or in which they may be used.
COMPLAINT
We sincerely trust that no customer has cause for complaint with any aspect of the service they receive. However, should any problem arise, we would ask that you email us immediately at info@akbearings.co.uk clearly marking your email “Complaint” so that it is passed to the relevant section without delay. We will endeavour to keep you informed of the progress of your complaint at all times.
By ordering item(s) from AK Bearings, you will be deemed to have accepted the Terms & Conditions as set out here and UK law will prevail.
